The right of silence has been affected by changes in Statutes in recent years.

 

Nowadays in Court the Prosecutors try to diminish your version of events if you do not give that version at a time earlier to Police when you were given the opportunity to do so.

 

Nevertheless, in our experience, it is better initially to decline any Police request for a record of interview and to keep your silence until you have spoken to a Solicitor. Then, with the benefit of legal advice as to possible implications, you may decide whether or not to agree Police interview.

 

Traffic Laws require you, as driver, to provide your name, address and licence if requested by Police. But thereafter you are not obliged to explain yourself.

 

Whatever predicament, be polite and keep a cool head with Police because any adverse reactions or statements may only aggravate your case later in Court.

 

We take care to see you and any witnesses as quickly as possible after an incident, as as to record your version whilst it remains fresh in your mind. Attention to detail can make a big difference.
